>> the fallout of the cia director david petraeus sent shock waves through out washington. he tendered his resignation after an investigation revealed he had an affair with paula broadwell. we know the fbi was aware of the affair for months part of an investigation ghan with threatening e-mails ladies and gentlemenedly sent by broadwell tol a petraeus family friend joe kelly a woman who is not romantically link to do petraeus. some are questioning why the president accepted the resignation. >> are you going to investigate why the fbi didn't know ynotify before? >> yes. this is something that could have had an effect on national security. i think we should have been told there is a way to do it that is just to inform the chair and

could find out what happened in benghazi before, during and after the attack if general petraeus doesn't testify. it is essential he gives testimony before the congress so we can figure out benghazi. you have got the department that needs to explain themselves intelligence committee. god knows the state department needs to answer for their behavior regarding benghazi. i would suggest we have the house and senate members we do this together not have three different committees going off in three different directions so we can get to the bottom of it like we did in watergate and iraq contra. that would be smart for the congress to combine resources. >> it will take place thursday. the state department says she will not be able to because she will be out of the country. >> let's get to your top 5@5:00.

co-workers and students remembering a second grade teacher and her husband who were killed in an explosion in indianapolis. ♪ jennifer longworth taught school at southworth elementary for 12 years. she and her husband lived in one of the homes that was destroyd in a blast that rocked an indianapolis neighborhood on saturday night. >> when i found out she died i really tried. she would always read stories. >> she loved her job. >> a real loss to the community. hundreds of people have been forced from their homes. following an explosion investigators say it could take weeks before they know what caused that explosion. >> a police station became the scene of the crime when a fatal shoot out occurred between officers and a 64-year-old

patrick murphy. the initial report showed it was lost by just 25 votes. they agreed to a partial recount because of problems with the early ballots. folks are thanking military veterans for their service and their sacrifices. >> new york city people lining the streets from the annual veteran's parade. celebrations to collect donations for super storm sandy victims. a more somber event in arlington, virginia. that's where president obama laid a wreath at the tovsh of the unknown. marking a major milestone at the vietnam memorial at washington, d.c. this year is the 30th anniversary of that war. >> in california, california veterans erecting a war memorial cross in the mojave desert.

people without power in new york and new jersey after super storm sandy. the result hundreds of residents of long island new york protesting over the weekend. they say they want answers. wnyw robert moses is in east method doe long island with an update. two weeks without power it has been awfully cold out. a lot of folks are really upset. >> good morning to you. good morning everyone. you heard the protestors saying more trucks, more drugs. the long island power authority checked numbers before we went on the air. more than 63,000 power authority customers still do not have power. you can see there was significant damage during hurricane sandy. that is part of the reason why this restoration is taking so long. protestors gathered over the weekend to express their dispressure as you could see and hear.

exposure to cell phone radiation could cause hyperactivity and memory problems in children. u.s. airlines threatened with the most serious pilot shortage since the 1960s. nearly half of the american pilots are over the age of 50. there won't be enough qualified candidates to replace the thousands who will reach the mandatory retirement age that is 65 in the future. later this week congressional leadership will meet at the white house to hammer out a deal to avoid going over the fiscal cliff. both parties are willing to work together something they failed to do in the past. the biggest challenge might be agreeing on taxes. >> doesn't make any sense to us to raise taxes on job creators at this time of economic challenge. the equation is revenue and spending. we can increase revenue without increasing the tax rates on anybody in this country. >> we can't expect an unfair deal that piles all of this on

the middle class and tells them they have to support it. we have to make sure that the we wealthiest americans pay their fair share. >> will washington be able to compromise? if so that will that endale? we are joined by democratic strategist brian benjamin and republican strat byes brian morgan stern. >> is this possible? can congress compromise? >> yes, congress can compromise. it has to include a tax increase on the wealthiest americans. let's not forget it was under bill clinton where he taught 22 million jobs created we had a higher tax rate. i don't think this idea that higher tax rates stopped economic growth. what stopped economic growth is the parties making a difference. we have to come to an agreement and accept the fact that president obama won the election which included the tax increases for the wealthiest americans.

>> tell me what you think is fair if we do compromise and taxes are raised he ran on staying howls holds have been make that go money and above will see taxes go up. is that fair? >> no. that is a level that has to move. they are bringing other revenue sources to the table including capping deductions and closing loopholes. that number the president is digging its heels on are where the margin matters and it will effect the job market. the white house will have to give on that point. >> we don't want to see taxes go up for everyone. that tax rate we may see a compromise. with deductions and closing loopholes. >> what do you think we can

expect? >> both are agreeing on the same point. we are going to expect something small. we need to make a real difference on our deficit. we have to have serious tax increases. we have clearance spending cuts as well. we have to be fair. we have to rely on the middle class to take it to the front. >> does it make sense to raise taxes when the economy is so poor? >> it is a tough situation. we have a deficit problem that can create other problems down the road. we have to prepare for the future. the only way to do that is to have tax increases and understand we are in a tough time. so we have tax cuts for those who are making less money we will figure it out. the wealthiest americans have not paid their fair share since the busheir raw.

>> welcome back to "fox & friends first". i am health irresponsibility nauert. >> i am ainsley earhardt. the scandal involving former cia director david petraeus continues to unfold this morning. we now know the target of the threatening e-mails that prompted the investigation we know her identity. >> there are some concerns over whether petraeus' mistress knew state secrets. doug luzader joins us with the latest. >> what we are learning now is the affair between david petraeus and his biographer paula broadwell may have been something of a known secret and something the fbi may have known about for months there. may be questions about whether broadwell may have disseminated

classified information in recent months as well. the fbi has been looking into this case for quite sometime. it began with threatening e-mails sent by broadwell to the petraeus family friend kelly not romantically linked to petraeus. they released this statement we and our family have been friends with general petraeus for over five years. we respect his and his familiar lace privacy and want the same for us and our three children. all of this raises questions of timing. was this information all held until after the leblgs to protect the president? the white house says no but some lawmakers felt blind sided. >> then when these questions came up i obviously tack took t action myself to try to find out and then informed by vice-chairman and i talked to the director twice. this is very hard stuff. plus petraeus was schedule to do
